Armando Rosquete Published in The Florida Bar Journal

Mr. Rosquete’s article on the Florida Secrecy of Communications Act was chosen for publication by The Florida Bar Journal.  The article discusses the Florida Supreme Court’s 2014 decision in McDade v. State, 154 So. 3d 292 (Fla. 2014) where the Court held that a defendant accused of child molestation has an expectation of privacy in conversations between him and his victim taking place in their shared residence where he asked her to have sex with him and also alluded to his prior acts of sexual abuse. The article also discusses the merits of the Florida Legislature’s amendment to the Florida SCA aimed at addressing the Court’s ruling.
